1 – Delivery Time and Methods
The supplier will deliver the selected and ordered products according to the methods specified on the website, and confirmed in the email as specified in point 4.2. Shipping is free for the buyer.
The Product is delivered exclusively in Italy and PO Boxes are not accepted as a mailing address.
As highlighted in clause No. 3 of this agreement, the presentation of the Products in the E-Shop is exclusively available to buyers residing in Italy who specify a delivery address within Italy.
Users residing outside Italy must access the E-Shop through the specific section reserved for their country of their residence.
The supplier shall make all reasonable efforts to process a Purchase Order within 5 (five) business days from the day of receipt of the Purchase Order.
The courier service is operational from Monday to Friday from 9:00 a.m. to 5:00 p.m. Orders received on Saturdays, Sundays or public holidays are processed on the next business day.
Unless unforeseen circumstances beyond the control of the supplier occur, the Product is delivered to the buyer within 7 (seven) days from the day of delivery to the courier.
This delivery time is indicative and non-binding. The Supplier accepts no liability for damages resulting from delays in delivery.
In case of failed delivery to the address specified by the Buyer in the Purchase Order, a second delivery attempt will be made to the same address. If the courier fails to deliver the Product even after such a second attempt, the Product will be stored at the courier’s warehouse that is closest to the delivery address and a notice will be left to the buyer listing the required information for pick up.

2 – Method of payment and reimbursement
Any payment by the Buyer can only be issued by means of one of the methods specified in the specific web page by the Supplier, or online by bank wire transfer, cash on delivery and PayPal.
Any refund to the Buyer will be credited by one of the methods specified by the Supplier and chosen by the Buyer, in a timely manner and, if the right of withdrawal is exercised, as regulated by the relevant clause of this agreement, no later than 30 days from the date in which the Supplier became aware of the withdrawal.
All payment transactions are performed on an encrypted system made available by the Supplier. The Supplier guarantees the storage of this information with an additional level of security encryption and in compliance with the provisions of current legislation on the protection of personal data.

3 – Withdrawal right
In any case, the Buyer shall have the right to withdraw from the agreement, without penalty and without specifying the reason, within 15 (Fifteen) business days from the day of receipt of the goods purchased.
If the Supplier failed to meet the obligations on the information on the existence, manner and timing of return or pick up of the goods in the case of exercise of the right of withdrawal under Art. 52 of the Consumer Code, the time limit for exercising the right of withdrawal is 90 (ninety) days and starts from the day of receipt of the goods by the consumer.
If the Buyer decides to exercise the right of withdrawal, he/she must notify the seller by registered letter with return receipt to the address VIA FONTE POMAROLA 27, 63812 MONTEGRANARO (FM) or by fax to the number 0734/893370 or by e-mail to info@francogentili .it provided that such notifications are confirmed by sending a registered letter with return receipt to the address …… within 48 (forty-eight) hours or by certified e-mail to the address ….
To exercise the right of withdrawal, the notification may be validly replaced by the return of the goods purchased, provided that this occurs according to the same terms.
The date of delivery to the post office or courier shall be deemed to be the date acknowledged by both parties.
The return of the goods must in any case take place at the latest within 30 (thirty) days from the date of receipt of the goods.
In any case, in order to be entitled to a full refund of the price paid, the goods must be returned intact and, in any case, in a standard preservation conditions.
The Buyer may not exercise this right of withdrawal for purchase agreements of audiovisual products or sealed computer software, which have been opened, as well as for custom goods or goods clearly personalized or which, by their nature, cannot be returned or are likely to deteriorate or expire rapidly, as well as for the supply of newspapers, magazines, as well as goods whose price is linked to fluctuations in currency rates that are beyond the Supplier’s control and in any other case provided for in Article. 55 of the Italian Consumer Code.
The only expenses to be borne by the Buyer to exercise the right of withdrawal under this article are the direct costs of returning the goods to the Supplier, unless the Supplier agrees to bear such costs. 13.7. The Supplier shall refund the entire amount paid by the Buyer at no cost within 30 (thirty) days of receipt of the notice of withdrawal.
Upon receipt of the notification by which the Buyer informs of the decision to exercise the right of withdrawal, the parties to this agreement are released from their mutual obligations, without prejudice to the provisions of the preceding points of this article.
